Terms of Use and Service

Section 1. Publisher and definitions

Ateliat is published and operated by Axa Zara LLC, a company registered in the State of Delaware, United States, located at Coastal Highway, Lewes, Delaware 19958, United States. You may contact us at support@chariow.com.

• “Ateliat” means the mobile application, related web interfaces, and services that provide access to Chariow purchases.
• “Chariow” means the technology platform creators use to sell and distribute their products and services.
• “User” means anyone who accesses Ateliat.
• “Creator” or “Seller” means the person or entity offering a product or service.
• “Product” includes a file, course, license, bundle, coaching session, service, ticket, or other digital content.
• “Access Right” means personal authorization to use a Product following a valid purchase or allocation.
• “User Content” means reviews, messages, comments, and other material submitted by a User.

Section 2. Purpose of Ateliat

Ateliat is a buyer portal. It lets you find purchases associated with the same email address on Chariow, view or download files, take courses, view licenses, manage coaching sessions, receive notifications, contact the relevant Creator, and rate a purchase.

Ateliat currently does not allow you to purchase or gift a Product within the application. Ateliat is not a marketplace, bank, financial institution, payment service provider, or merchant of record for the Products.

Section 3. Relationship with Chariow and Creators

Section 4. Eligibility

If you act for an organization, you represent that you have authority to bind it.

• You must be at least 18 or the legal age required to enter into a contract in your country.
• You must have the legal capacity to accept these Terms.
• You must use an email address associated with a valid purchase or Access Right.
• You must provide accurate and current information.
• You must not be legally prohibited from using the service.

Section 5. Territorial restrictions

Ateliat and the related Chariow services are operated from the United States. As of the effective date of these Terms, the Chariow services accessible through Ateliat are not intended for persons or entities located in a member state of the European Union.

You represent that you are not located in a jurisdiction where use of the service is prohibited. If you access the service from another territory, you are responsible for complying with local law. Mandatory rights that cannot legally be excluded continue to apply.

Section 6. Access and authentication

Ateliat may offer a sign-in code sent to the email address associated with your purchases or sign-in through Apple, Google, Microsoft, Yahoo, or Axa Zara. No Ateliat password is required when you use a code.

You are responsible for securing your device, email address, codes, and sessions. You must sign out of devices you no longer control and promptly email support@chariow.com if you suspect unauthorized access.

We may reasonably verify your identity or Access Right before disclosing information, restoring an account, or handling a sensitive request.

Section 7. Free access to Ateliat

Standard access to Ateliat is currently free for buyers. No Ateliat subscription is required to view eligible purchases.

This does not mean that Products are free. Product prices, taxes, fees, refunds, and payment terms are determined outside the application, on Chariow or by the Creator.

We may later offer optional paid features. Before any charge, they will be clearly disclosed and subject to separate acceptance.

Section 8. License to use Ateliat

Subject to these Terms, Axa Zara LLC grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use Ateliat on compatible devices.

• You may not copy, sell, rent, or redistribute Ateliat.
• You may not bypass security or access-control mechanisms.
• You may not reverse engineer Ateliat except where applicable law expressly permits it.
• You may not extract data in bulk or automate access without written authorization.
• You may not use Ateliat to build a competing service or disrupt its operation.

Section 9. Product Access Rights

Unless the Creator grants a different license, your Access Right is personal and non-transferable. You may not share a license key, private link, document, session, or credentials with an unauthorized person.

The scope and duration of the right depend on the Product description at purchase, the Creator’s license, any expiration date, activation limits, order status, and applicable law.

Ateliat seeks to provide lasting access to valid purchases but does not guarantee perpetual or unconditional access.

• Access may be suspended or withdrawn following a refund, cancellation, or payment rejection.
• It may expire or be revoked under the applicable license.
• It may be withdrawn because of fraud, abuse, account deletion, a security threat, infringement of third-party rights, or a legal obligation.

Section 10. Downloads and offline use

Ateliat may let you store certain Products on your device. You must use those files under their license, secure your device, and delete copies if your Access Right expires or is revoked.

You may not share, resell, publish, or make files available without authorization, or bypass a protection against copying or export.

Ateliat is not a personal backup service. Uninstalling the application or losing, resetting, or experiencing a failure of your device may delete local files.

Section 11. Courses and progress

Ateliat may record your progress, last playback position, time spent, and completed lessons to synchronize your learning experience.

Videos, meetings, and links may come from third-party services that control their own availability and rules. Creator training and information are provided under the Creator’s responsibility and do not guarantee any financial, professional, educational, or personal outcome unless expressly promised.

Section 12. Coaching, services, and tickets

Appointments, services, and events are provided by the Creator. You must verify the date, time zone, location, and prerequisites, arrive on time, and follow the communicated rules.

Cancellation, rescheduling, attendance, and refund terms are those presented at purchase or by the Creator, subject to applicable law. Account deletion may cancel upcoming sessions.

Section 13. External links and payments

Ateliat may display a link to Chariow, a Creator’s website, or another external service. Any order and payment is then completed outside Ateliat and is subject to the terms of the relevant website and its payment providers.

The availability of Apple Pay, Google Pay, payment cards, or another payment method on an external page does not mean Ateliat processes the payment or that Apple or Google bills it as an in-app transaction.

Section 14. Communications with Creators

Ateliat may let you contact the Creator associated with a purchase. By sending a message, you authorize us to forward the information needed to respond, including your identity, contact details, purchase reference, and message content.

The Creator is responsible for handling the request after receiving it. Axa Zara LLC does not guarantee a response time or the outcome of a claim.

Section 15. User Content

You retain ownership of your User Content and remain responsible for its legality. You represent that it does not infringe third-party rights, include confidential data you may not disclose, or contain fraudulent, defamatory, hateful, threatening, obscene, unlawful, or malicious material.

You grant Axa Zara LLC a worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, display, and technically adapt your User Content solely as needed to operate, secure, and improve Ateliat.

We may remove or restrict content that violates these Terms, the law, or third-party rights. Where appropriate, you may ask support for human review.

Section 16. Prohibited uses

• Using Ateliat for unlawful, fraudulent, or deceptive purposes.
• Accessing another person’s account or Products without authorization.
• Sharing or selling credentials, files, licenses, or access.
• Bypassing access controls, activation limits, or technical safeguards.
• Scanning or testing vulnerabilities without written authorization.
• Disrupting servers, networks, APIs, or notification systems.
• Using an unauthorized bot, scraper, or automated script.
• Introducing malicious code, impersonating someone, or harassing any person.
• Infringing intellectual property rights or applicable sanctions.

Section 17. Notifications

Ateliat may send notifications about purchases, licenses, courses, coaching sessions, access, security, and news. You can manage categories in the application and withdraw permission in your device settings.

Certain communications required for security, authentication, or legal compliance may be sent by email regardless of promotional preferences. Delivery depends in part on Apple, Google, Firebase, the network, and your device, and is not guaranteed.

Section 18. Support, refunds, and purchase disputes

For a technical issue with Ateliat, email support@chariow.com. For questions about Product content, quality, performance, or a refund, first contact the Creator from the purchase page when that feature is available.

Ateliat does not change the refund policy applicable to a purchase. Axa Zara LLC may intervene only as provided by the Chariow terms, a dispute process, or applicable law.

Section 19. Availability and changes to the service

Ateliat may be interrupted for maintenance, an update, an outage, a security incident, a legal obligation, or an event outside our reasonable control.

We may add, change, or remove a feature. If a material change substantially affects your rights or access to a valid purchase, we will provide reasonable notice where possible. Any future catalog or marketplace feature will be governed by updated terms before launch.

Section 20. Suspension and termination

You may stop using Ateliat and sign out at any time. When the feature is available, you may request account deletion. A 30-day grace period currently applies after confirmation.

We may immediately suspend an account because of fraud, a security risk, unlawful activity, serious infringement of third-party rights, or a material violation of these Terms. For a violation that can be corrected, we may provide a reasonable cure period.

Terms that by their nature should survive termination remain in effect, including provisions on intellectual property, liability, disputes, and accrued obligations.

Section 21. Intellectual property

Ateliat, its code, design, trademarks, logos, text, and original elements are protected and belong to Axa Zara LLC or its licensors.

Products remain the property of their Creators or rights holders. Purchase or access does not transfer ownership unless the Product license expressly states otherwise. Open-source components remain governed by their licenses.

Section 22. Warranties, liability, and indemnification

Section 23. Dispute resolution and arbitration

This section affects your rights. Before starting a proceeding, each party agrees to try in good faith to resolve the dispute for 60 days. Email a detailed description to support@chariow.com with your name, account email, and requested resolution.

Subject to the exceptions below, any unresolved dispute will be resolved through individual, binding arbitration under the American Arbitration Association Consumer Arbitration Rules. The arbitration will be conducted in English and seated in Delaware, unless applicable rules provide for remote proceedings or another location.

To the fullest extent permitted by law, each party waives participation in class actions, class arbitrations, and representative proceedings.

Section 24. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. This clause does not deprive a consumer of mandatory protections under the law of their country where those protections apply and cannot be waived.

Section 25. Sanctions and export controls

You represent that you are not a sanctioned person or entity and will not use Ateliat for the benefit of any territory, person, or activity prohibited by applicable United States law, including rules administered by the Office of Foreign Assets Control. We may suspend access to comply with these obligations.

Section 26. Force majeure

Neither party is liable for delay or failure caused by an event beyond its reasonable control, including a natural disaster, war, major network outage, widespread cyberattack, government action, pandemic, or failure of a critical provider. This clause does not exclude an obligation that applicable law does not allow a party to disclaim.

Section 27. Changes to these Terms

We may change these Terms. For a material change involving your rights, Product access, liability, or disputes, we will give at least 30 days’ notice where reasonably possible.

Non-material corrections and clarifications may take effect when published. If you reject a change, you must stop using Ateliat before it takes effect. Continued use constitutes acceptance, subject to applicable law.

Section 28. General provisions

These Terms, the Privacy Policy, and expressly incorporated policies form the agreement governing Ateliat. They do not replace the terms governing a Chariow sale or Product.

If a provision is invalid, it will be adjusted only as much as necessary and the remaining provisions stay effective. Failure to enforce a right is not a waiver.

You may not assign your rights or obligations without our written consent. Axa Zara LLC may assign these Terms as part of a restructuring, merger, acquisition, or transfer of business, subject to applicable law.

The French version is the controlling version for Users to whom it is presented. A translation may be provided for convenience. Headings are for readability only.
